D & S Export Packing LLC warrants that products supplied are of merchantable quality at the time of delivery.

If a product is determined to be defective or non-conforming, D & S Export Packing LLC may, at its sole discretion:

replace the product at no charge; or issue a credit for the original purchase price.

No replacement or credit will be provided unless the claimed defect is verified through an independent inspection approved by D & S Export Packing LLC.

Buyer is responsible for inspecting all products immediately upon receipt and before use.

Any claim relating to defective, damaged, or non-conforming products must: be submitted in writing within ten (10) days of delivery; clearly describe the issue; and be submitted before the product is altered, modified, or used in a manner that changes its condition.

D & S Export Packing LLC reserves the right to inspect any product subject to a claim.

The full shipment must remain intact and available for inspection pending claim resolution unless otherwise authorized in writing.

No reimbursement or credit will be issued for repairs, alterations, or corrective actions performed without prior written approval from D & S Export Packing LLC.

To the fullest extent permitted by law, D & S Export Packing LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from: use of the products; delays in delivery; product failure; non-conformance to specifications; or any act of negligence, whether active or passive.

Buyer assumes full responsibility for ensuring products meet all dimensional, technical, and application requirements before use.

Unless otherwise stated on the invoice: all sales are F.O.B. Shipping Point; payment terms are stated on the applicable invoice; and risk of loss transfers to the buyer upon shipment.

Past due balances may incur a finance charge of 1.5% per month (18% annually), or the maximum rate permitted by applicable law.

Buyer agrees to pay all reasonable collection costs, including attorney’s fees, court costs, and collection agency fees incurred in recovering unpaid balances.

If buyer fails to fulfill payment obligations or otherwise defaults, D & S Export Packing LLC may, without prior notice:

declare all outstanding balances immediately due and payable; suspend future deliveries or services; repossess products where permitted by law; and/or pursue any legal remedies available under California law.

Buyer agrees that any legal proceeding arising from these Terms shall be brought exclusively in Los Angeles County, California.

For all C.O.D. sales, title to merchandise remains with D & S Export Packing LLC until payment has been received and fully cleared by the financial institution.

Returns will not be accepted without prior written authorization from D & S Export Packing LLC.

Approved returns are subject to: a minimum 25% restocking fee; inspection upon receipt; and possible reduction in credit if returned items are damaged.

Special-order, custom, or non-stock items are non-returnable.

All determinations regarding return condition and applicable credit amounts shall be made solely by D & S Export Packing LLC and shall be final.

D & S Export Packing LLC shall not be responsible for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to:

labor disputes or strikes; transportation interruptions; shortages of materials; supplier delays; fire, flood, or natural disasters; governmental actions or regulations; or force majeure events.

In accordance with California Civil Code Section 1719, buyers may be held liable for penalties, damages, collection costs, and legal fees resulting from dishonored or returned checks.

All content on this website, including text, graphics, logos, images, and materials, is the property of D & S Export Packing LLC and may not be copied, reproduced, distributed, or used without prior written consent.

Users agree not to: misuse the website; interfere with website functionality; attempt unauthorized access to systems or data; upload malicious software; or use the website for unlawful purposes.

D & S Export Packing LLC reserves the right to restrict or terminate access for violations of these Terms.

These Terms & Conditions shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.

D & S Export Packing LLC reserves the right to update or modify these Terms & Conditions at any time without prior notice.

Continued use of the website or purchase of products after updates constitutes acceptance of the revised Terms.

These Terms & Conditions constitute the complete agreement between the parties regarding the sale of products and use of this website and supersede all prior agreements or understandings unless agreed to in writing.
